Notes for: William Godbey, II

"1797, WILLIAM GODBEY, from Simon Chafin and Agatha, his wife, 100 acres Clabboard Creek, branch of New." Wm Godbey Will. In the name of God amen. I William Godbey being in perfect health (praise be to God for the same) and knowing it is appointed for all men once to die and as touching such estate as it hath pleased God to bless me with in this life, I bequeath in the following manner viz., Item. I lend to my beloved wife Zanner Godbey for her support during her natural life the plantation whereon I now live with the dwelling house kitchen and all other appurtenances: two feather beds and furniture and such parts of my household furniture as shall be thought necessary for her by my Executors, also all my kitchen furniture and after the decease of said wife Zanner it is my will that all the personal property lent to her as aforesaid be sold and the proceeds thereof be equally divided between my children as hereafter mentioned. Item. After my said wife's decease I give to my son Benjamin Godbey all that part of my plantation from above the deadning spring branch beginning at a chesnut oak up the river to where it intersects with Kelly's line being at a chesnut and ash saplings at the river, thence beginning at said Chesnut oak on the river bank thence to a chesnut on the top of the hill, thence to a pine across the field, thence to a white oak upon a hill and thence East to Pattens line. This I bequeath to my son Benjamin during his natural life, the wright of said Benjamin is not divested in said Benjamin in any way whereof to dispose of during life, being of the value of Four hundred dollars for his heirs to have and to hold forever. Item. I give and bequeath to my son Francis Godbey all the residue of my plantation Beginning at a chesnut oak below the deadning spring branch as aforesaid and running down the river and around to a mark line (from the deadning spring branch to where it intersects with Pattens line) to him and his heirs forever being of the value six hundred dollars. I give and bequeath to my son William Godbey the plantation I purchased of Thomas Evans at Seventy one pounds to him and his heirs forever. Item. I give and bequeath to the children of Sarah Gunter the plantation I purchased of Isaac Berry of the value of Thirty pounds to them and their heirs forever. Item. I give to my wife Zanner a negro woman named Jude one boy named Jim and one girl child named Ama also being Horses she may proper also ten
hogs and two cows, during her natural life and after her decease to be disposed of as hereafter mentioned. Item. It is my will that all my personal property consisting of negroes, Horses, cattle, Sheep & Hogs to be sold after my decease and the proceed, of each sale be equally divided between my children, Francis Godbey, William Godbey, Gabriel Godbey, George Godbey, Benjamin Godbey, Sarah Gunter's children an equal part of the proceeds of such sale at the same time given said Sarah Gunter an alife estate in said property. Patsey Farmer, Lucy Hedge and the children of Susanna Covey one equal part of the proceeds of such sale at the same time giving said Susanna Covey a life estate in said property and after the decease of my wife, it is my will that the personal property devised to her during her life be sold and the proceeds divided equally between my above named Children & grand children.

Item. It is my will that all my just debts be paid by my Executors out of the first moneys that come into their hands. Item. I leave one old negro man named Europe to my Executors to be amply provided for and taken care of during life. Item. I hereby constitute and appoint my sons Francis, William and George Godbey Executors of this my last will and Testament. In witness whereof I have hereunto set my hand and affixed my seal this 28th day of October in the year of our Lord one thousand eight hundred and twenty nine.

At Montgomery January Court 1833
This last will and Testament of William Godbey deceased was presented in court and proven by the oaths of Robert L. Currin and Lynch A. Currin two of the witnesses thereto subscribed and ordered to be recorded. And on the motion of George Godbey and Francis Godbey two of the executors therein named who made oath and together with securities security entered into and acknowledged bonds in the penalty of Ten thousand dollars each, conditioned as the law directs, a certificate is granted them for obtaining a probate of the said will in due form.
