Notes for: Abraham ("Abram") Lowe Bodine

I had wondered if his middle initial "L" might stand for "Low." That was a wild guess, but it looks to be right after Ronny Bodine found his will and sent that to me. See the notes from Ronny further below (I have an image of that will on my computer).

I had also thought that this Abraham could be related to Joseph Maddison Bodine and John Bodine, husband of Esther Mattison. That was also a guess which looks to be accurate based on Abrahamīs will. We are making a few guesses here, but the will was really important in making a few jumps we needed to make.

I'm had thought that this Abraham might otherwise be the same as the Abraham Bodine who was the son of John Bodine and Lemme Cozine. That Abraham was supposedly born on January 4, 1808. Whereas this one, was supposedly born in December 4, 1808. I donīt think that is true now, but it is something to keep in mind.

From Genesee County, New York Deed Book 64, p. 20:
Deed of 5 June 1839 from Joseph Bodine and Elizabeth, his wife, of Elba, Genesee County to Abraham L. Bodine of Skaneateles, Onondaga County, for $1600, 65 acres & 81 rods in Elba. Recorded 7 Aug 1842.

From Genesee County, New York Deed Book 81, p. 94:
Deed of 15 July 1851 from Abram L. Bodine of Skaneateles, Onondaga County to Joseph Bodine of Oakfield, Genesee County, for $2000, 65 acres & 81 rods in Elba, Genesee County. Recorded 6 Jan 1852.

From Genesee County, New York Deed Book 95, p. 71:
Deed of 1 April 1856 from Joseph Bodine & Mary Ann, his wife, of Oakfield, Genesee County to Abraham L. Bodine, of Barre, Orleans County, for $8400, 133 1/4 acres in Oakfield. Recorded 19 June 1856.

Abraham Bodine cannot be located in the 1850 census, but from the cited deeds was a resident of Skaneateles, Onondaga County. In June 1860, Abram L. Bodine, age 51, lived in Oakfield, Genesee County, New York with his wife Emma A., 51 and child Anne E., 19 and one William Young, age 14. His next door neighbor was Samuel C. Bodine and his family, to include his father, Joseph Bodine, age 64. In Aug 1870, Abraham 'Bedine,' 61 and his wife Amy, 67, lived in Barre engaged in farming. It is assumed here that Amy A. and Emma A., born born about 1808 in New Jersey were the same person. In June 1880, Amy Bodine, age 67 and widowed, lived in Barre, Orleans County. Her household included her nephew, William Young, age 34. Abraham and Amy Bodine were buried in West Barre Cemetery, Barre, Orleans County, New York.

Last Will and Testament of Abraham Lowe Bodine of Orleans County, New York, written 26 Aug 1868 and proved 14 Aug 1876. (Orleans County Will Book 10, pp. 445-447)
I Abraham L. Bodine, farmer, of the town of Barre Orleans County and State of New York aged fifty nine years, in order to dispose of my property after my death according to my present wishes to make, publish and declare this my last Will and Testament in manner and form as follows.
First. In case my present Wife Amy A. Bodine outlives me I give bequeath and devise to her, and to her heirs assigns forever all that house and lot of land on which I now reside, situated at West Barre, Orleans County, bounded on the east and south by land of Elisha Wright; North by land of Charles Kelner and Andrew King; and west by a public highway, containing ten acres of land.
I also give and bequeath to my said Wife absolutely, should she survive me, all my house hold furniture, to have and hold the provision so made for her I lieu of dower out of any property.
I also give and bequeath to my said Wife the use, produce, increase, profits and enjoyment of all my personal estate, and of all my real estate to have and possess, dispose of as she may see fit during her natural life, requiring and directing as soon after my disease as this Will shall be proved with ordinary diligence, my Executors make an inventory of all my real and personal property the use of which is hereby given to my wife during her life, and file a copy of said inventory in the Surrogate's Office in Orleans County.
I direct and will that my said wife may not apend or diminish the amount of the capital of the property in which she has such life estate.
She may not sell the real estate or commit wast thereon, but she may sell exchange or dispose of the personal estate for the better enjoyment of said personal estate under this Will as may be necessary.
At the death of my said Wife I give, devise and bequeath all my real estate and all my personal estate that may then remain to the children and heirs at law of my brothers John, Joseph, Peter and I. Seaborn, and of my Sister Mary, who may be living at the time of the death of my said wife, to them and to their heirs and assigns absolutely.
If my said Wife should die before I do, in that case I give and devise to my nephew Samuel C. Bodine, of the town of Oakfield, Genesee County, New York, all my household furniture and the ten acres of land above referred to as given to my said wife to have and hold the same in trust for William N. Youngs, nephew of my wife, who has for some time resided in my family. Said Trustee is hereby authorised and empowered to take the property so devised and given to him in trust into his custody, and to control, manage and take care of the same and expend all the avails and produce and income thereof for the benefit of the said Youngs of his family if he should have one; retaining sufficient for his just compensation for executing this trust. Said Trustee may sell or dispose of said furniture as he may see fit; but he may not sell said real estate.
When said William H. Youngs shall die I give and devise said ten acres of land to his child or children his heirs at law, should he leave any him surviving. If he leaves no such child, then I give and devise said ten acres to the heirs at law of my said wife absolutely.
I hereby revoke all Wills by me heretofore made, and nominate and appoint my said wife Amy A Bodine Executrix, and Arad Thomas Esq. of Albion Executor of this my last Will and testament. Witness my hand and seal this 26 day of August 1868.

Last Will and Testament of Amy A. Bodine of Barre, Orleans County, New York, written 18 Sept 1877 and proved 4 Sept 1882. (Orleans County Will Book 14, pp. 201-202.)
The will names nephew William H. Young to receive house and land conveyed to her by "my husband Lowe Bodine, deceased, by his last will bearing date the 26th day of August 1868, and proved before the Surrogate of Orleans County on the 14th day of August 1876 and recorded in the said Surrogate office August 14, 1876 in Book 10, Record of Wills Page 445." William H. Young is appointed executor.

Abraham Bodine, in his will of 1876, having no surviving children, named his heirs as his wife Amy, and after her death his surviving siblings or their heirs. To fulfill the requirements of the will, it was necessary to identify all the potential heirs and this was accomplished in the subsequent probate. The following notice was published in the Albany Evening Journal of Wednesday, 28 June 1876.

Whereas Amy A. Bodine and Arad Thomas, executors named in the last will and testament of the said Abraham L. Bodine, deceased, have applied to the surrogate of the said county of Orleans for the proof of the said will which will related to real and personal estate; you are therefore hereby cited to appear before the surrogate, at his office in Albion in said county, on the 14th day of August, 1876 at 10 o'clock in the afternoon, to attend tne probate of the said will.

In testimony whereof I have hereunto set my hand and affixed my seal of office, at Albion, Orleans county the seventh day of June, 1876. JNO. O. SAWYER, Surrogate

The named heirs, all living in 1876, and their relationships to the testator are identified as follows in the order of the births of Abraham Bodine's siblings:
1. JOHN C. BODINE died 1848. His heirs were his 6 surviving children: Daniel H. Bodine, Catherine Bodine Sutphin, Margaret Bodine Marden, John M. Bodine, Melvina Bodine Pecare and Mary Bodine King.
2. JOSEPH M. BODINE died 1868. His heirs were his children Mary Bodine Curtiss, John W. Bodine, Samuel C. Bodine, Joseph H. Bodine and the heirs of his deceased daughter Ann Bodine Humphrey who were her sons Keith and Charles Humphrey. Joseph's eldest daughter, Harriet Bodine Hill (1827-1909) appears to have been overlooked.
3. PETER BODINE died 1866. His heirs were his 7 surviving children: Elizabeth Bodine Vansyckle, Daniel S. Bodine, Mary Bodine Cregar, Hettie Bodine, Catherine Bodine Hill, Abraham Low Bodine (named as Lowe Bodine), and Jane Bodine DeWitt.
4. DANIEL S. BODINE died before 1846. One heir is named, Mary Ann Tyson.
5. MARY BODINE NIXON died in 1832. Her children were Elizabeth Nixon and Hester Nixon (1830-1874), wife of John Thornton Petty. As Hester was deceased at the probate of the will, her share of the estate passed to her children: George H. Petty, William W. Petty, Whitfield C. Petty, Francis D. Petty, Jacob Petty, Sarah J. Petty, Alonzo Petty, Orin Petty, Ella Petty, Thomas Petty, Ida J. Petty, Margaret M. Petty, Lucius I. Petty, Lewis Z. Petty and John F. Petty.

One heir, Mary K. Chapman could not be identified.
