Powel DeHart's Last Will and Testament
In the name of God, Amen, I, Powel DeHart of the township of North Brunswick in the Co. of Middlesex and the State of New Jersey, being of sound mind and memory and understanding so make and publish this, my last Will and testament in manner following, that is to say
First, It is my will an I do order that all my just debts and funeral expenses be duly paid and satisfied as soon as conveniently can be after my decease.
Second, I do give and devise and bequeath unto my beloved wife Joanna, the sum of four hundred dollars to be paid to her as soon as can be by my Executors after my decease, which said bequest and the payment thereof. I do hereby make a charge and lieu upon my real estate provided, however, and this bequest to my said wife is hereby declared to be in full satisfaction and in lieu of all her dower and right of dower in my real estate. I do also demand bequeath unto my said wife all such household goods and chattels as she brought to my house and used after the time of my marriage to her to disposed of by law as she shall think proper.
Thirdly, I do also give, devise, and bequeath unto each of the children of my deceased son, the sum of fifty dollars and to each of the children of my deceased daughter, Ida Ann, late the wife of William Blakeney, the sum of fifty collars, to be paid by my Executors, as soon after my decease as convenient. And in case of the decease of any of the said children, the legacy of any such deceased child shall be paid to his or her child or children, brother or sister as the case may be. All which ???? legacies and the payment thereof, I do hereby make a charge and lieu upon my real estate.
Fourthly, All the rest and residue of any estate, both real and personal, I do order to be divided into four equal parts, one equal fourth part, thereof I do give, devise, and bequeath unto my son, Jacob, his heirs, and assigns forever. One equal fourth part, thereof, I do give, devise, and bequeath unto my son, Henry, his heirs and assigns forever. One equal fourth part thereof, I do give, devise, and bequeath to my son Nicholas, his heirs and assigns forever. The other equal fourth part, thereof, I do five, devise, and bequeath unto my daughter, Alisa(?), wife of William Meseroll, her heirs and assigns forever.
Fifthly, I do, hereby, nominate, constitute and appoint my son, Nicholas B. DeHart, and my friend, Will J. Cortleyou, Executors of this my last Will and testament, truly revoking all former Wills by me made.
In testimony, whereof, I have hereunto set my hand and affixed my seal this fourteenth day of June in the year of our Lord, one thousand eight hundred and fifty four.
