Notes for: John Evans

The evidence for the marriage between Mary Bodine and John Evans seems pretty weak. I'm not sure where I got this information from. John Evans' marriage to a Mary Bodine seems only based upon his will. I'm not sure if there is any other evidence to back this marriage up. Her nephews, Isaac and Jacob Bodine, sons of her brother, Cornelius Bodine, were witnesses for this will and on the occasion when it was proven. Information also comes from Mary's will. This is located in "Loudoun County Wills," Book D, pages 10-12. Her will was proved on September 8, 1788.

Loudoun County Will Book A, pages 260-262:

In the name of God amen. I John Evans of Loudoun County being weak in Body but of perfect mind and memory thanks be given unto God....do make and ordain this my last will & Testament; that is to say principally and first of all I give and recommend my Soul into the hands of almighty God that gave it and my Body I recommend to the Earth to be buried in a decent Christian burial at the discretion of my Executors...and as Touching such worldly Estate wherewith it has pleased God to bless me in this life I give demise and dispose of the same in the following manner & form. First I give and bequeath to Mary Evans my dearly beloved Wife the benefits arising from my whole Estate after the Debts is paid until my Son William Evans comes to the years of twenty one (Except my wife should see cause to marry before) and then she must deliver up two thirds of the land and two thirds of the moveable estate. I give and bequeath unto my Son William Evans the two thirds of the plantation when he arives at the years of twenty one or when he marries if he should see cause to marry before together with the Log end of the Dwelling house and kitchen with one bay horse colt & small ffrench gun and at the decease of his Mother I give & bequeath him the remainder of the land. I give and bequeath unto my beloved Daughters Amy Henderson, Charity Perril, Mary Evans, Catherine Evans, & Sarah Evans the sum of twenty five pounds each (deducting twenty pounds from Amy Henderson, twenty pounds from Charity Perril & that the said Legacies be paid out of the moveable estate, but if the moveable Estate should not be sufficient to pay the legacies that William Evans make it up to them as each child comes to the years of twenty one. I likewise constitute make & ordain my dearly beloved wife Mary Evans & Jacob Read Executor & Executrix of this my last Will & Testament...in witness whereof I have hereunto set my hand & seal this sixteenth day of March in the year of our Lord one thousand seven hundred & seventy.

NB if my Son William Evans should die without issue that the plantation be sold and equally divided amongst my daughters. And I likewise reserve one quarter of an acre of land for a burying yard where my family is now buried, to Remain for that purpose forever.

At a Court held for Loudoun County August the 13th 1770

This will was proved by the Oaths of Jacob Bodine and Isaac Bodine Witnesses thereto & ordered to be recorded and on the motion of Jacob Reed the Executor therein named who made oath according to Law certificate is granted him for obtaining a Probat thereof in due form giving security Whereupon he together with Simon Triplet and Francis Peyton Gent. his security enter'd into & acknowledged Bond in the penalty of five hundred pounds Virginia currency with condition as the Law directs, And on the 14 day of the same month At a Court contd. & held for said County on the motion of Mary Evans Widow & Executrix and her making Oath according to Law certificate is also granted for obtaining a probat thereof giving security whereupon the said Mary with Francis Peyton & William Smith Gent. enter'd into & acknowledged their Bond in the penalty of three hundred pounds current money with condition as the Law directs, the said Mary having first relinquished in Court and benefit that she might claim by any devise in the said Will according to Law.
