Western Union Tel. Co. v. Berdine. Court of Civil Appeals of Texas. March 9, 1893.
Suit instituted April 1891 by V. E. Berdine of Fort Bend. Plaintiffs child was sick for 4 days previous to 11 July 1890. On that day plaintiff transmitted the following message via telegraph "Thompson, Texas, July 11th, 1890. Dr. Fields, Alvin, Texas: Come up next train. Child very sick. V. E. Berdine." Defendants failed to transmit the message until 12 o'clock, 12 July and consequently Dr. Fields was unable to see the child until 8 P.M. on 12 July, and this delay resulted in the death of the child the following day about 3 P.M. The case went to trail 19 Oct 1891 and the defendant was found liable to the amount of $1,999, but the case was appealed and was remanded for another trial.
