Elizabeth, widow of James Bodine, died 3 June 1863 at the age of 76 at the home of her son-in-law Matthew Newkirk.

The will of Elizabeth Bodine of Montgomery, Orange County, was written in June 1856. Therein, she made bequests to "my son Virgil Thompson" of $100; "children of my son Horace Thompson, Decd." of $100 to be equally divided among them; "children of my son Howard Bodine, Decd." of $60 to be equally divided among them; Caty Maria, wife of Mathew Newkirk of $100; Elmer Bodine of $100; Fanny Bull, widow of Benjamin Bull, of $100; Mehatable K., wife of Frederick Newkirk, of $100; and Elizabeth Newkirk, daughter of Mathew Newkirk, of $100. Bushrod Millspaugh was appointed executor. Adam J. Bodine and Hiram B. Sherman were witnesses. The probate identified all of the next of kin of Elizabeth Bodine as Howard Bodine, a minor under age 21, for whom Charles G. Elliott was appointed Special Guardian on 1 Dec 1863; Catharine M. Newkirk and Elmer Bodine, both residents of Montgomery, Orange County, who were served 12 Dec 1863; Mahetable Newkirk and Emma Stiner, residents of the city and county of New York, who were served 9 Dec 1863; and Fanny Darling, resident of Cherry Ridge, Penn. who was served 19 Dec 1863. NOTE: It appears that the child recorded as Elnour, born 17 Sept 1816, was meant to be Elmer, who was also born in 1816 and whose parentage is otherwise unknown. The 1830 Orange County census of the family of James Bodine is a perfect depiction of the family in its appropriate age groupings: For the males, James Bodine was already deceased and the oldest male was aged 20-29 (born 1801-10), who is unknown at this time. The other males were aged 10-14 (born 1816-20) which would be ELMER, and aged 15-19 (born 1811-15) which would be Howard. For the females, one was aged 5-9 (born 1821-25) for Mehittable, 10-14 (born 1816-20) for Fanny, 15-19 (born 1811-15) for Catharine, and 40-49 (born 1781-90) for Elizabeth Bodine. Elmer Bodine was also named as an heir of his mother in her will and served as a witness to the marriage of his sister, Mehittable to Frederick Newkirk in 1848.
